Suspicious Transaction ReportSTR
Also called STR/SAR
An STR is a report a reporting entity must send to the FIU when it suspects, or has reasonable grounds to suspect, that a customer, transaction or property is linked to money laundering, terrorist financing or another offence.
Explained
Legal basis: Section 7S (७ध) of the Asset (Money) Laundering Prevention Act, 2064 requires the reporting entity to inquire and report immediately to the FIU.
NRB Directive 19 rules for BFIs:
- Build a system to detect suspicious transactions, including unusual large or complex transactions under Section 7N (७ढ).
- File STR/SAR only through goAML, following the FIU's STR/SAR Guidelines and goAML Operational Guidelines.
- Classify STRs: STR-PEP where a politically exposed person is involved, STR-TBML where trade-based money laundering is suspected, and others as STR-High, STR-Medium or STR-Low under internal procedure.
- When an investigating agency asks for a customer's details and the matter is suspicious, file an STR too.
- Reporting in good faith gives protection from liability (Section 37), and staff must not tip off the customer (Section 44A).
An STR is not proof of crime; it is intelligence for the FIU to analyse.
Example
A student account suddenly receives many transfers from unrelated people and the money is withdrawn in cash the same day. The pattern does not fit the customer's profile, so the bank files an STR through goAML.
