Trade-Based Money LaunderingTBML
Also called STR-TBML
TBML is disguising proceeds of crime and moving value through trade transactions, typically by over-invoicing or under-invoicing goods, misdescribing goods, or multiple invoicing.
Explained
Common techniques:
- Over-invoicing imports: paying more than the goods' value sends extra money abroad.
- Under-invoicing exports: the foreign buyer keeps the difference abroad.
- Multiple invoicing of one shipment, or phantom shipments with no goods at all.
- Misdescription of quality or quantity.
Banks see TBML risk mainly in letters of credit, documents against payment/acceptance and advance payments for imports. Red flags include prices far from market rates, unusual routes, goods inconsistent with the customer's business, and third-party payments.
NRB Directive 19, point 16(4) requires BFIs to classify STRs connected with money laundering through import and export trade as STR-TBML when reporting to the FIU.
