सम्पत्ति शुद्धीकरण
Also called Asset Laundering, मनी लाउन्डरिङ
Money laundering is converting, transferring, hiding or using property derived from crime so that its illegal origin is concealed and it appears legitimate.
Explained
Section 3 of the Asset (Money) Laundering Prevention Act, 2064 makes it an offence to:
- convert or transfer property knowing (or having reasonable grounds to believe) it is proceeds of crime, to hide its illicit origin or help an offender escape;
- conceal or disguise the true nature, source, location, disposition, movement or ownership of such property;
- acquire, use or possess such property knowingly.
Abetting, conspiring, facilitating or attempting these acts is also an offence. The predicate offences (corruption, tax evasion, drug trafficking, human trafficking, fraud and others) are listed in the Act's Schedule.
Three classic stages:
- Placement: dirty cash enters the financial system (for example many small deposits).
- Layering: funds move through complex transfers to break the audit trail.
- Integration: funds return as apparently clean wealth such as property or business income.
Penalty (Section 30(1)): fine of double the amount involved and 2 to 15 years' imprisonment depending on gravity.
Example
A person splits cash from a bribe into many deposits just below the reporting level in several accounts, then transfers it abroad and buys property in a relative's name. Each step (placement, layering, integration) is part of laundering.
In Nepal
The NRB Unified Directive cites Nepal's National Risk Assessment and the 2023 Mutual Evaluation Report as identifying corruption, tax evasion and human trafficking among high-risk predicate offences, and asks BFIs to monitor accounts of casino, precious metal, real estate and cooperative businesses on priority.
