Terrorist FinancingTF
Also called Financing of Terrorism, CFT
Terrorist financing is providing or collecting funds or property, by any means, knowing or intending that they will be used for a terrorist act or by a terrorist person or organisation.
Explained
Unlike money laundering, terrorist financing can use clean money (salaries, donations, business income) and often small amounts. The focus is the destination of funds, not their source.
Legal basis: Section 4 of the Asset (Money) Laundering Prevention Act, 2064 prohibits financing terrorist acts, persons or organisations. Chapter on listing (Sections 29E to 29K) lets the government designate terrorist persons, groups and organisations and requires immediate freezing of their funds.
Penalty (Section 30(3)): fine of five times the amount involved, or Rs 5 crore if the amount is not established, and 7 to 20 years' imprisonment depending on gravity.
The Act also covers financing of the proliferation of weapons of mass destruction (PF), which is why the framework is often written AML/CFT/CPF.
