Also called AML/CFT/CPF, Anti-Money Laundering,
AML/CFT is the set of laws, institutions and controls that prevent criminals from disguising illegal proceeds and stop funds from reaching terrorists or weapons proliferators.
Explained
Nepal's AML/CFT framework has four layers:
- Law: the Asset (Money) Laundering Prevention Act, 2064 (Act No. 24 of 2064, amended several times, most recently by the third amendment of 2083) and its Rules of 2081.
- Policy and coordination: a National Coordination Committee and a Directive Committee under the Act (Sections 7W (७ब) and 7X (७भ)), plus the National Strategy and Action Plan.
- Intelligence and investigation: the Financial Intelligence Unit (FIU-Nepal) inside NRB receives and analyses STRs and TTRs (Sections 9-10), and the Department of Money Laundering Investigation investigates (Section 11).
- Reporting entities and regulators: banks, insurers, securities firms, cooperatives and others must apply KYC, risk assessment, record keeping and reporting; regulators supervise them (Sections 7T and 7U, ७न-७प).
For BFIs, NRB's Directive 19 sets detailed rules: risk-based CDD, PEP and beneficial-owner checks, sanctions screening, TTR within 15 days, STR immediately, SAR within 3 days, an AML/CFT unit headed by a management-level compliance officer, and a board-level AML committee.
In Nepal
NRB's Monetary Policy 2082/83 committed to coordinate implementation of the action plan Nepal received for removal from the FATF grey list and to give top priority to the APG third-round Mutual Evaluation recommendations for regulators.
