Tipping Off
Also called Disclosure of STR
Tipping off is informing a customer or any third person that a suspicious transaction report has been or will be filed, or that an investigation is under way.
Explained
If a launderer learns that the bank has reported them, they can move funds or destroy evidence, so tipping off is prohibited.
Legal basis:
- Section 44A of the Asset (Money) Laundering Prevention Act, 2064 prohibits disclosing information or notices relating to ML/TF reports and investigations.
- Section 10B requires confidentiality of information received by the FIU, and Section 31 punishes breach of that confidentiality.
- Section 37 protects reporting entities and their staff from punishment for information given in good faith under the Act.
For bank staff this means: never tell the customer that an STR or SAR was filed, do not hint at it while asking for source of funds, and limit knowledge of reports to those who need it.
