Pledge
Also called Pawn,
A pledge is the delivery of movable goods or documents to a lender as security, so that the lender holds possession until the loan is repaid while ownership stays with the borrower.
Explained
In a pledge (pawn), the borrower (pledgor) physically hands over goods to the lender (pledgee). Common examples in banking are gold and silver ornaments kept in the bank's vault for a gold loan, goods kept in a warehouse under the bank's lock and key, and shares or fixed deposit receipts placed under the bank's control.
Key features
- Only movable property can be pledged.
- The pledgee must take reasonable care of the goods and return them on repayment.
- If the borrower defaults, the pledgee can sell the goods after giving notice and recover dues; any surplus goes back to the borrower.
Because the bank holds the goods, a pledge is safer for the lender than hypothecation. NRB's rules for gold loans require the pledged gold or silver to be tested and kept in a single sealed bag per borrower.
