Lien
Also called Banker's lien, Right of lien
A lien is a creditor's right to keep possession of a debtor's property or funds until the debtor pays what is owed.
Explained
A lien only gives a right to retain, not to sell, unless the agreement or law allows it. Two types are common:
- Particular lien: the right to hold specific goods for dues related to those goods.
- General lien: the right to hold any goods of the debtor for any general balance owed. A banker has a general lien over securities and valuables of a customer that come into the bank's hands in the ordinary course of banking.
In practice, "lien marking" means putting a hold on a deposit account or fixed deposit so that the amount cannot be withdrawn while a loan or guarantee is outstanding. A loan against the bank's own fixed deposit is typically secured by a lien on that deposit. Banker's lien does not apply to items deposited for safe custody.
