KYC is the process by which a bank identifies a customer and verifies that identity with reliable documents before and during a business relationship. It is the first line of defence against money laundering, fraud and terrorist financing.
Explained
In Nepal KYC is a legal duty under Section 7A of the Asset (Money) Laundering Prevention Act, 2064 and the Asset (Money) Laundering Prevention Rules, 2081, and NRB adds detail in Directive 19 of the Unified Directive 2082.
Key points of Directive 19:
- Identify and verify every customer and, for legal persons, each layer of ownership up to the controlling natural person.
- From 1 Magh 2081 BFIs must open accounts on the basis of the National Identity Card or its number, verified against the electronic national ID record. Nepalis living abroad may open online accounts with other documents and update the national ID within 35 days of returning.
- Accounts may be opened electronically if identity, geolocation and verification are assured.
- Take photo, signature or biometrics of account holders and operators.
- Customer documents follow Annex 19.1.
- Update KYC of high-risk customers at least once a year, and immediately when transactions do not match the profile or doubts arise.
- A person who cannot satisfy KYC must not be given an account or business relationship.
Example
A walk-in customer with no account wants to exchange foreign currency worth more than Rs 1 lakh in a day. Directive 19 requires the bank to collect identity documents from that occasional customer before completing the transaction.
In Nepal
NRB Monetary Policy 2082/83 said BFIs would be facilitated to obtain KYC details through the National Identity Card and to share updated KYC electronically once a customer updates details at any bank.
