Bank and Financial Institution (BFI)BFI
बैंक तथा वित्तीय संस्था
Also called Licensed institution, इजाजतपत्रप्राप्त संस्था
A public limited company licensed by Nepal Rastra Bank under the Bank and Financial Institution Act, 2073 to carry out banking and financial transactions such as accepting deposits and lending.
Explained
A BFI is the umbrella term Nepali law uses for every licensed deposit-taking or lending institution regulated by Nepal Rastra Bank (NRB).
Legal basis (BAFIA 2073)
- A BFI must be incorporated as a public limited company and needs NRB's prior approval to be set up.
- Nobody other than a licensed BFI may carry out banking and financial transactions (Section 31).
- Section 37 lets NRB classify a BFI as class "A", "B", "C" or "D" on the basis of its minimum paid-up capital and the type and area of its business. An infrastructure development bank is not placed in any class.
- Section 49 lists the transactions each class may do; class A has the widest scope.
Why it matters NRB regulates BFIs through the NRB Act 2058, BAFIA 2073 and the Unified Directives. Classes A, B and C follow one Unified Directive, while class D (microfinance) has its own.
In Nepal
BFIs are licensed and supervised by NRB. The Monetary Policy 2083/84 says NRB will complete a study on reclassifying BFIs and gradually apply regulations that encourage them to expand services in targeted areas.
