A written instruction from the drawer asking the bank not to pay a specific cheque that has been issued but not yet paid.
Explained
When it is used Lost or stolen cheques, cheques issued in error, disputes with the payee, or suspected fraud.
Procedure
- The account holder gives a signed instruction stating the cheque number, date, amount and payee, and the reason.
- The bank marks the cheque number in the core banking system so the cheque will be returned if presented.
- The instruction must reach the bank before the cheque is paid; a paid cheque cannot be stopped.
- The holder can later revoke the stop instruction in writing.
NRB rules
- Fee: BFIs may not charge any fee for a stop payment instruction (Unified Directive 20).
- Blacklisting risk (Directive 12): stop payment is accepted as justified where a cheque is lost, stolen or used without authority. If an account holder stops payment for any other reason after issuing the cheque, and the cheque is therefore not paid, the bank gives the issuer seven days' notice (excluding public holidays) to pay. If payment is still not made, at the holder's request the bank asks the Credit Information Bureau to blacklist the issuer and related parties.
So a stop payment is not a safe way to escape a genuine obligation.
