Prompt Corrective ActionPCA
Also called PCA Bylaw 2074,
A set of graded supervisory actions that NRB takes automatically when a bank or financial institution's capital adequacy ratio falls below the required minimum, becoming stricter as the shortfall grows.
Explained
The NRB Prompt Corrective Action Bylaw, 2074 (approved by the NRB board on 2074/01/19, under NRB Act Section 110) applies equally to A, B, C and D class institutions. For this bylaw, the capital ratio means the minimum total capital excluding the conservation buffer.
Actions by size of shortfall from the minimum ratio:
- Shortfall up to 25%: discuss a correction programme with senior management, demand a recapitalisation plan, ban cash dividend and bonus shares, ban new branches, freeze increases in directors' allowances and senior management pay.
- More than 25% up to 50%: all of the above, plus caps on total deposits and lending, ban on new business activities, NRB approval before acquiring fixed assets, freeze on staff incentives.
- More than 50% up to 75%: all of the above, plus ban on new deposit accounts and new or increased loans, freeze on staff pay increases and new hiring; if the minimum is not restored within 6 months, action against directors and the chief executive under NRB Act Section 100(2).
- More than 75%: all of the above, plus declaring the institution problematic under Section 86 of the NRB Act, and if not fixed within 6 months, merger, acquisition, licence cancellation or liquidation.
Example
If the minimum is 11% and a bank's ratio is 9.9%, the shortfall is 1.1 points, or 10% of the minimum, so the first tier of actions (dividend ban, branch ban, capital plan) applies.
In Nepal
The tiers are measured as a percentage shortfall relative to the minimum ratio, not as percentage points.
