Consumer Protection Act, 2075

Purpose: To protect and promote consumers' constitutional right to quality goods and services, provide judicial remedy and compensation for harm. Authenticated 2075/06/02 (18 September 2018), Act No. 10 of 2075.

Structure: 11 chapters, Sections 1-65.

Key provisions:

• Section 2(d): consumer means a person or institution that consumes or uses goods or services.
• Section 3: consumer rights, including access, choice at fair price, information on price and quality, safety, legal action against unfair trade, compensation and hearing.
• Chapter 3: liability of parties in marketing goods and services.
• Section 16: prohibition of unfair trade and business; Section 17: no acts adversely affecting demand, supply or price.
• Chapter 5: price determination.
• Chapter 6: Consumer Protection Council; Section 25: Central Market Monitoring Committee.
• Chapter 8 (Section 38 onward): offences and punishment.
• Section 41: Consumer Courts; Chapter 10: compensation.
• Section 65: repeals the Consumer Protection Act, 2054.

Bank customers are consumers of financial services; transparent pricing of fees and interest, fair advertising and complaint handling reflect the rights in Section 3, alongside BAFIA Section 118 and NRB's customer protection directives.

संरचना: ११ परिच्छेद, दफा १ देखि ६५।

मुख्य व्यवस्था:

• दफा ३: उपभोक्ताका हक: सहज पहुँच, उचित मूल्यमा छनोट, मूल्य र गुणस्तरको जानकारी, सुरक्षा, क्षतिपूर्ति र सुनुवाइ।
• दफा १६: अनुचित व्यापार व्यवसाय निषेध।
• दफा २५: केन्द्रीय बजार अनुगमन समिति।
• दफा ४१: उपभोक्ता अदालत; परिच्छेद १०: क्षतिपूर्ति।
• दफा ६५: उपभोक्ता संरक्षण ऐन, २०५४ खारेज।

बैङ्कका ग्राहक वित्तीय सेवाका उपभोक्ता हुन्; शुल्क र ब्याजको पारदर्शिता तथा गुनासो सुनुवाइ यस ऐन र बाफियाको दफा ११८ सँग जोडिन्छ।
