Shell Bank
A shell bank is a bank that has no physical presence (no real office, management or records) in the country where it is incorporated and licensed, and is not part of a regulated financial group.
Explained
Shell banks are a classic channel for money laundering because no supervisor can effectively examine them.
Legal basis: Section 7 of the Asset (Money) Laundering Prevention Act, 2064 prohibits anyone from establishing or operating a shell bank in or through Nepal. Section 6 also bars reporting entities from dealing in anonymous or fictitious names.
In practice, Nepali banks must not open correspondent relationships with shell banks and must check that their foreign correspondent banks do not let shell banks use their accounts. NRB's Directive 19 requires cross-border correspondent relationships to follow Section 7M (७ड) of the Act and to be reviewed periodically, ending the relationship if the correspondent does not comply with AML/CFT measures.
