Public Procurement Act, 2063PPA

Purpose: To make public procurement procedures and decisions more open, transparent, objective and reliable, and to ensure competition, fairness, honesty, accountability and value for money. Authenticated 2063/09/30 (Act No. 36 of 2063).

Structure: 10 chapters, Sections 1-76: preliminary; responsibility and methods of procurement; bids; consultancy services; other procurement provisions; review of procurement decisions; procurement contracts; conduct; monitoring; miscellaneous.

Scope: Section 2 defines public entity to include companies, banks and other bodies fully or mostly owned or controlled by the federal or provincial government, so government-owned banks follow this Act.

Exam focus: procurement responsibility and methods (Chapter 2), bids and their evaluation (Chapter 3), review of procurement decisions (Chapter 6), procurement contracts (Chapter 7) and monitoring (Chapter 9).

Amendments: 2072, First Amendment 2073, 2075, 2082 and the Public Procurement (Second Amendment) Act, 2083.

RBB, NBL and ADBL buy IT systems, buildings and services under this Act and the Public Procurement Regulations, while private banks follow their own procurement policies.

संरचना: १० परिच्छेद, दफा १ देखि ७६।

दायरा: दफा २ अनुसार नेपाल सरकार वा प्रदेश सरकारको पूर्ण वा अधिकांश स्वामित्व वा नियन्त्रणमा रहेका कम्पनी, बैङ्क लगायत संस्था सार्वजनिक निकाय हुन्।
