Order Cheque

Features

• Written as "Pay X or order", or with the word "bearer" struck out.
• To transfer it, the payee signs on the back (endorsement) and delivers it; the new holder can endorse again.
• The paying bank must check that the person receiving payment is the payee or a valid endorsee. Under NI Act Section 58, paying an order cheque in due course to the payee or endorsee discharges the bank.

Safer than bearer A finder or thief cannot get payment without forging the endorsement, and a bank that pays on a forged endorsement without due care may be liable.

Endorsement types used with order cheques Blank endorsement (signature only) turns it effectively into a bearer instrument; special endorsement names the next payee; restrictive endorsement limits further transfer (NI Act Sections 2, 31 and 32).

In practice Most order cheques are also crossed, so they are collected through a bank account.

विशेषता

• "X वा निजले अह्राएकोलाई भुक्तानी दिनु" भनी लेखिन्छ वा "बियरर" शब्द काटिन्छ।
• हस्तान्तरण गर्न भुक्तानी पाउने व्यक्तिले पछाडि दस्तखत (दरपीठ) गरी सुम्पन्छ; नयाँ धारकले फेरि दरपीठ गर्न सक्छ।
• भुक्तानी लिने व्यक्ति भुक्तानी पाउने व्यक्ति वा वैध दरपीठ प्राप्त व्यक्ति हो भनी बैंकले जाँच्नुपर्छ। ऐनको दफा ५८ बमोजिम निजलाई रीतपूर्वक भुक्तानी दिएपछि बैंक मुक्त हुन्छ।

धारक चेकभन्दा सुरक्षित भेट्टाउने वा चोर्नेले दरपीठ किर्ते नगरी भुक्तानी पाउँदैन, र उचित सावधानी नअपनाई किर्ते दरपीठमा भुक्तानी गर्ने बैंक जिम्मेवार हुन सक्छ।

अर्डर चेकमा प्रयोग हुने दरपीठ साधारण दरपीठ (दस्तखत मात्र) ले यसलाई व्यवहारमा धारक अधिकारपत्र बनाउँछ; विशेष दरपीठले अर्को भुक्तानी पाउने व्यक्ति तोक्छ; प्रतिबन्धात्मक दरपीठले थप हस्तान्तरण सीमित गर्छ (ऐनको दफा २, ३१ र ३२)।

व्यवहारमा अधिकांश अर्डर चेक रेखाङ्कित पनि हुन्छन्, त्यसैले बैंक खातामार्फत संकलन हुन्छन्।
